from what I recall, it's front-wheel-drive based, so when 4wd is off and there's nothing to slip on, it's 100% FWD. Then when the Patriot detects some slipping, it automatically sends up to 20-30% of power to the rear wheels, as needed. Like EW said it may be a bad sensor. Not sure which scanner you used, but not all code scanners (i.e. lower cost) are able to retrieve ABS codes so you might want to try another scanner.
